EVEREST FITNESS CHALLENGE: TERMS & CONDITIONS

These Terms & Conditions ("Terms") govern participation in the Everest Fitness Challenge ("Challenge") organized by VersaClimber, a brand of Heart Rate Inc. ("Sponsor"). By participating, you agree to be bound by these Terms.

SECTION 1: ELIGIBILITY

To be eligible, participants must:

  • Be 18 years of age or older at the time of entry.
  • Be legal residents of the United States, Canada (excluding Quebec), the United Kingdom, or Mexico, where this Challenge is not prohibited by law.
  • Have access to a compatible VersaClimber device and the VersaClimber app or touchscreen console.

Employees, officers, and directors of the Sponsor or its affiliates, and their immediate family members, are not eligible.

SECTION 2: TAX RESPONSIBILITY

All taxes on the prize and related expenses are the sole responsibility of the winner. In the United States, prizes valued over $600 may be reported to the IRS via Form 1099. Participants from other countries are responsible for complying with their local tax laws. VersaClimber makes no representations about the tax implications of receiving this prize.

SECTION 3: HOW TO PARTICIPATE

  • Acceptance of these Terms is required.
  • Participants must opt in to the Challenge via the VersaClimber app or console.
  • Participants must complete 29,032 vertical feet of climbing during the 27-day Challenge period.
  • Progress must be tracked automatically via the VersaClimber system. No manual entries will be accepted.

[ ] I understand that only activity recorded via a connected VersaClimber will count toward completion.

SECTION 4: PRIZE DRAWING & SELECTION

  • One (1) winner will be selected at random from the pool of eligible participants who complete the Challenge.
  • The drawing will occur within seven (7) days of the Challenge’s end.
  • The winner will be notified via their account email and must confirm acceptance within 72 hours.

SECTION 5: PRIZE & REIMBURSEMENT GUIDELINES

The winner will receive up to $2,500 USD in total value as a travel credit for an Everest Base Camp trek.

All reimbursement amounts are in U.S. dollars (USD). Currency conversion or international transfer fees, if any, are the responsibility of the participant.

  • Participants must submit valid receipts for reimbursement.
  • Sponsor must approve the selected trek provider if not using a recommended vendor.
  • The travel credit must be used within 12 months of award date. Unused funds are forfeited.

[ ] I understand that while I am accepting the prize now, I must meet all redemption requirements—including providing valid travel and medical insurance—prior to booking or commencing travel. I also understand that reimbursements will be processed only after valid receipts are submitted and approved.

SECTION 6: MEDICAL READINESS & ASSUMPTION OF RISK

Redeeming the travel prize involves strenuous physical activity and high-altitude trekking (up to 6,000 meters). Before any travel reimbursement is issued, the winner must submit:

  • Either a signed doctor’s note or a completed self-certification form confirming they are medically fit for high-altitude trekking:
  • Acknowledge all risks, affirming that they understand the physical demands of the trip and voluntarily accept all associated risks; and
  • Acknowledge they have read and understand all requirements and recommendations of Intrepid Travel found at https://www.intrepidtravel.com/us/nepal/everest-base-camp-trek-160343/tripnotes#essential-medical-information

The self-certification form, if used, will include confirmations such as:

  • No recent history of chest pain, dizziness, or fainting
  • No bone, joint, heart, or respiratory conditions limiting strenuous activity
  • No physician-advised activity restrictions
  • No pregnancy or condition that limits safe participation
  • Not currently taking medications that would limit exercise or altitude tolerance

[ ] I understand that I must provide valid documentation of medical readiness before travel. I accept that participation in the trek carries risks and release Heart Rate Inc. and VersaClimber from all liability related to travel or physical activity.

SECTION 7: LIMITATION OF LIABILITY

Sponsor and its affiliates shall not be liable for any direct, indirect, incidental, or consequential damages arising from participation in the Challenge or use of the prize. This includes, but is not limited to, injury, illness, property damage, or death occurring during any portion of travel—including commercial flights, regional air transfers, or ground transportation.

Sponsor is not responsible for the conduct, performance, or safety of third-party service providers, including airlines, guides, or trekking operators.

[ ] I acknowledge that travel to and from Everest Base Camp, including regional flights such as the route from Kathmandu to Lukla, may involve heightened risks, and I accept that participation and prize use are undertaken at my own risk.

SECTION 8: PUBLICITY RELEASE

As a condition of accepting the prize, the winner agrees to participate in reasonable promotional and marketing activities related to the Everest trek experience, including providing photos, videos, and/or testimonials during and after the trip. Winner grants VersaClimber the right to use such content, along with the winner’s name, likeness, and story, in print, digital, social media, and other promotional materials without additional compensation, except where prohibited by law.

[ ] I grant VersaClimber permission to use my name, likeness, and challenge data in marketing.
[ ] I agree that any photos or videos I choose to share may be used by VersaClimber for promotional purposes.

SECTION 9: GENERAL TERMS

Sponsor may modify, suspend, or cancel the Challenge at any time due to technical issues, fraud, or force majeure. Sponsor’s decisions are final and binding.

SECTION 10: GOVERNING LAW

These Terms are governed by California law. Any disputes shall be resolved in state or federal courts located in Orange County, California.

SECTION 11: SIGNATURE & DATE

By signing below, I acknowledge that I have read and understood the Terms & Conditions and agree to abide by all requirements related to prize redemption, travel, and liability.
